Platform Access & User Registration
Access to the Mitchell Auction platform is granted to individuals and entities capable of forming legally binding contracts under applicable law.
By registering, you warrant that all provided information is accurate, complete, and current. Mitchell Auction reserves the right to suspend or terminate accounts with inaccurate information.
- Users must be at least 18 years of age.
- Each user is responsible for maintaining account confidentiality.
- Commercial entities must provide valid business identification.
Account Security
You are solely responsible for all activities under your account. Notify us immediately of any unauthorized use.
Bidding Process & Transaction Rules
All bids placed are considered binding offers to purchase the asset at the submitted price, subject to the auction's specific terms.
The bidding timeline is strictly enforced. Bids submitted after the closing time are invalid. Mitchell Auction acts as an intermediary and is not a party to the final sales contract.
- Bids cannot be retracted once placed, except under defined platform errors.
- Winning bidders are obligated to complete the purchase transaction.
- Payment must be made within the specified period following the auction close.
Reserve Prices & Seller Obligations
Assets may have a confidential reserve price. Sellers are obligated to provide accurate lot descriptions and disclose known material defects.
Asset Listings & Descriptions
Listings are prepared by sellers. While we facilitate a structured catalog, Mitchell Auction does not independently verify the condition, title, or specifications of each asset.
Procedural documentation for each lot is provided for informational purposes. It is the bidder's responsibility to inspect assets (physically or via provided data) prior to bidding.
- "As-is, where-is" basis applies unless explicitly stated otherwise.
- Photographs and specifications are not guaranteed warranties.
- Discrepancies between listing and asset must be reported prior to bid submission.
Fees, Payments & Liabilities
Buyers and sellers agree to the fee structure published on the platform. All fees are non-refundable unless required by law.
Mitchell Auction's liability is limited to the total fees collected for the specific transaction in question. We are not liable for consequential, indirect, or incidental damages.
- Buyer's premium may apply to the final hammer price.
- Sellers are responsible for applicable taxes on sale proceeds.
- Disputes between buyers and sellers must be resolved directly between the parties.
Transaction Framework
The platform provides a regulated format for payment processing and documentation transfer, but does not assume title or possession of assets.
Prohibited Conduct & Platform Use
Users must not engage in any activity that disrupts the operation or fairness of the auction platform.
This includes, but is not limited to, shill bidding, fraudulent misrepresentation, hacking attempts, or uploading malicious content.
- Manipulation of the bidding process is strictly forbidden.
- Users must comply with all applicable export control and sanctions laws.
- The platform may not be used for illegal or unauthorized purposes.
Amendments, Governing Law & Contact
These terms may be amended periodically. Continued use of the platform constitutes acceptance of the revised terms.
This agreement is governed by the laws of the jurisdiction where Mitchell Auction is registered. Any disputes shall be subject to the exclusive jurisdiction of courts in that location.
